Can my wages be garnished?

I just received a letter stating that my wages (25%) are going to be garnished for an old medical bill that I didn’t pay. I’m in the process of claiming bankruptcy right now. I have already given my lawyer a $500 deposit and I’m filling out the paperwork. I’m just waiting on my tax refund to pay the rest of the money and file. Is there any way that I can stop this garnishment from occuring since I’m going to be claiming bankruptcy within the next month?
I did get a summons in regards to this bill, but my lawyer said not to worry about it because he would call and handle it since I’m claiming bankruptcy, but appartently he didn’t do anything. So unbeknownst to me there was a judgment filed against me and now my wages will be garnished this Friday unless I can get a release of withholding from the law office filing this garnishment.

Have you been to court and lost? If not this is a bluff because without a judgment from the courts wages can not be garnished.

If you have been to court and the collection company has a judgment call them and tell them your filing bankruptcy and give them your lawyers phone number, be sure and speck with your lawyer first so they will be up to speed.

Additional information.

I feel sorry for you since you obviously have a lousy lawyer all he had to do is show up in court and tell them that your in the process of filing bankruptcy and this would have never happened but since it already has there really is nothing you can do until your bankruptcy is actually filed then the garnishment will stop.
